Ms. Smith has litigated and won numerous reproductive rights cases, most recently Carhart v. Ashcroft, the successful federal challenge to the "Partial Birth Abortion Act" decided in Nebraska on September 8th. (She was co-counsel in Stenberg v. Carhart, the U.S. Supreme Court case striking down a Nebraska "partial birth" law on similar grounds.) Ms. Smith argued and won Ferguson v. City of Charleston at the Supreme Court in 2001, representing ten women who were secretly searched for cocaine use and subsequently arrested or threatened with arrest while voluntarily seeking prenatal care. In other cases, she successfully defended a Florida woman charged with murder for shooting herself in the stomach while pregnant, and a Wisconsin woman charged with attempted murder for consuming alcohol shortly before her expected delivery date. She has challenged restrictions on abortion in Louisiana, Arkansas, Michigan, Oklahoma and Iowa.

Ms. Smith is one of the country's foremost reproductive rights lawyers. She is here to discuss the challenges to reproductive rights she sees on the horizon -- both legislation and litigation -- from the perspective of an on-the-ground litigator.
